Portaria disciplina procedimentos para pagamento de sentenças judiciais

Foi publicada no Diário Oficial esta semana a Portaria da Secretaria de Orçamento Federal (SOF/MP), que disciplina os procedimentos para a solicitação de créditos adicionais destinados a pagamento de sentenças judiciais no âmbito das empresas estatais dependentes do orçamento da União.

De acordo com a SOF, hoje não existe uma regra clara a respeito do assunto para estes órgãos, e, portanto, a idéia é orientá-los para a adequada solicitação de créditos relacionados ao pagamento de sentenças judiciais transitadas em julgado.

Segundo a Portaria, as solicitações para pagamento de sentenças de valores inferiores a R$ 100 mil deverão ser acompanhadas de manifestação da área jurídica da respectiva empresa, incluindo o ateste da força executória da sentença judicial; o número do processo ou da ação judicial; o nome do reclamante, a vara de execução, a data do trânsito em julgado; a finalidade da ação e o valor da sentença a ser paga.

Já as solicitações para pagamento de valores superiores a R$ 100 mil devem apresentar, além das informações requeridas para os valores inferiores àquele montante, outros documentos como a cópia do certificado de trânsito em julgado e a memória de cálculo demonstrando o valor devido atualizado até a data da solicitação. Toda a documentação deve ser encaminhada à SOF para análise.

O encaminhamento de solicitações de créditos adicionais para pagamento de sentenças judiciais poderá ocorrer a qualquer tempo, desde que observadas as Portarias anuais da SOF relativas aos procedimentos e prazos limites para solicitação de alterações orçamentárias.

As estatais dependentes, ou seja, entidades que compõem o orçamento fiscal e da seguridade da União, compreendem hoje 18 órgãos, entre eles a Empresa Brasil de Comunicação (EBC), a Empresa Brasileira de Pesquisa Agropecuária (Embrapa) e a Companhia Nacional de Abastecimento (Conab).
