Ministra Carmem Lúcia pede vista e adia decisão do Supremo sobre direito à revisão geral para servidores

A sessão que iniciou julgamento no STF (Supremo Tribunal Federal) sobre direito à revisão geral para servidores públicos foi interrompida nesta quinta-feira, 9, pelo pedido de vista da ministra Carmem Lúcia. O Recurso Extraordinário (RE) que questiona a omissão do Poder Executivo sobre este direito assegurado pela Constituição Federal aos servidores recebeu voto favorável do ministro Marco Aurélio Mello. O ministro entende que toda vez em que União, Estados e Municípios não reajustarem valor dos salários dos trabalhadores públicos dentro do que prevê a revisão anual, o governo deve pagar valor integral ou diferença como indenização aos servidores. Com o pedido de vista fica suspensa a sessão ainda sem data confirmada para que o tema volte à pauta do STF. A assessoria jurídica da Condsef esteve na sessão desta quinta e segue acompanhando de perto o julgamento do recurso.

A expectativa da Condsef é de que o Supremo preencha mais essa lacuna deixada pelo governo. A entidade reforça que reajustes para correção de distorções salariais continuam sendo fundamentais e precisam ser assegurados para acabar com uma série injustiças existentes nos quadros do funcionalismo. Paralela a essas demandas, a luta para garantir data-base para 1º de maio é um dos eixos da Campanha Salarial 2011 que reúne mais de 30 entidades nacionais em defesa dos servidores e serviços públicos. Hoje, a Constituição prevê o dia 1º de janeiro como data para revisão geral. Mas há pelo menos quinze anos o Executivo não faz valer este direito aos servidores federais.
