Governo prepara mudanças na aposentadoria pública e privada

O governo emitiu dois sinais animadores sobre a Previdência Social. Em entrevista ao Valor, a presidente Dilma Rousseff manifestou a disposição de se empenhar para que o projeto de lei que cria a previdência complementar dos servidores públicos federais seja finalmente votado pelo Congresso. Ao mesmo tempo, o ministro da Previdência Social, Garibaldi Alves Filho, informou que estuda a proposta de estabelecer uma idade mínima para que o brasileiro possa requerer aposentadoria pelo Regime Geral de Previdência Social (RGPS), mais conhecido como INSS. A idade mínima substituiria o atual fator previdenciário.

O Brasil tem, atualmente, duas categorias de aposentados: os do setor público, com regras firmes e ganhos generosos, e os da iniciativa privada, com o benefício limitado atualmente a R$ 3.689,66, o chamado teto do INSS. No recente seminário “O Futuro da Previdência no Brasil”, realizado pelo Ministério da Previdência e pela Secretaria de Assuntos Estratégicos (SAE), o economista Marcelo Abi-Ramia apresentou números que dão a dimensão dessa desigualdade.

Enquanto o RGPS paga R$ 714, em média, aos aposentados do setor privado, o valor médio das aposentadorias do regime próprio dos funcionários é mais de oito vezes esse valor e chega a quase R$ 6 mil. Pior: essa desigualdade está sendo custeada por todos os contribuintes, pois o regime dos servidores apresentou um déficit no ano passado de R$ 51 bilhões (diferença entre receitas e despesas), coberto, é claro, pelo Tesouro Nacional. No mesmo ano, o déficit do RGPS foi de R$ 43 bilhões.

O mais estarrecedor dessa situação é que o déficit de R$ 51 bilhões decorre do pagamento a pouco mais de 940 mil aposentados e pensionistas do serviço público federal, enquanto que o déficit de R$ 43 bilhões refere-se ao financiamento de benefícios previdenciários de 24 milhões de trabalhadores, urbanos e rurais. Não é difícil concluir que esta situação contribui para a desigualdade da renda no Brasil, como observou Abi-Ramia.

O regime de previdência complementar para os servidores foi introduzido na Constituição pela emenda 20, de 1998, para igualar as regras previdenciárias dos funcionários públicos e dos trabalhadores da iniciativa privada. Os servidores também passariam a ter um teto para os seus benefícios, igual ao teto do RGPS, e poderiam participar de fundo de pensão para complementar o valor de sua aposentadoria, da mesma forma que os trabalhadores das empresas privadas fazem.

O texto deixou claro que a medida só seria aplicada às pessoas que ingressassem no serviço público após a instituição do regime complementar. Ou seja, não haveria ameaça a direitos adquiridos. Mesmo assim, o projeto de lei que cria a previdência complementar não conseguiu tramitar na Câmara dos Deputados por pressão das entidades representativas dos servidores, principalmente do Judiciário. Agora, com o empenho da presidente Dilma, espera-se que o dispositivo constitucional possa ser colocado em prática.

A fixação de uma idade mínima para requerer aposentadoria no RGPS – outra medida que vai na direção correta – é, por enquanto, só uma iniciativa do ministro Garibaldi, como ele próprio fez questão de ressaltar. Ele não recebeu qualquer orientação da presidente Dilma a este respeito e disse que resolveu estudar o assunto para apresentar uma alternativa ao fator previdenciário.

Como se sabe, o fator reduz o valor do benefício daqueles que se aposentam mais cedo, pois ajusta, por meio de uma fórmula matemática, o tempo de contribuição ao INSS com a idade ao requerer a aposentadoria e a expectativa de sobrevida. Traz como grande inconveniente o fato de o valor da aposentadoria ser imprevisível, pois este dependerá da tabela de expectativa de vida do IBGE em vigor quando for requerer o benefício.

Não há dúvida de que a definição de uma idade mínima para a aposentadoria, adotada por quase todos os países, é uma proposta melhor do que o fator. Uma alternativa poderá ser a soma do tempo de contribuição e a idade no momento da aposentadoria, fórmula conhecida como “Fator 95”. A iniciativa do ministro Garibaldi abre um debate sobre uma mudança que o Brasil precisa enfrentar o quanto antes. Por uma questão justiça, porém, a regulamentação da previdência complementar do servidor público é mais urgente.
