“Governo não está negociando com sindicato”

“O governo não pode tratar sua relação com outro Poder, que é independente, como se estivesse negociando com sindicato de motorista de ônibus”. A declaração é do presidente da Associação dos Juízes Federais, Gabriel Wedy, ao comentar a recusa da presidente Dilma Rousseff em negociar com a classe. Os magistrados pedem reajuste de 14,79% a título de perdas inflacionárias. As informações são do jornal O Estado de S. Paulo.

De acordo com o presidente da Ajufe, “o governo não pode ignorar o fato de que os juízes são agentes políticos do Estado com garantias constitucionais que não nossas, mas da sociedade”. Para os juízes, “a negociação entre um Poder de Estado e outro se dá em moldes diferentes da relação entre o governo e um sindicato”.

O pedido foi enviado pelo Supremo Tribunal Federal, em agosto de 2010, ao Legislativo. No entanto, até agora, o Congresso não se manifestou sobre o assunto. De acordo com a Ajufe, a omissão lhes subtrai direito constitucional de irredutibilidade de vencimentos. Por isso, assinaram Mandado de Injunção ao STF. O problema é que a pretensão vai contra o corte de R$ 50 bilhões no orçamento previsto pelo Palácio do Planalto.

Wedy lembra que o governo, ao negar o reajuste, está descumprindo a Constituição Federal. “Falta tato político ao governo. É importante que a presidente Dilma realize uma interlocução de forma mais qualificada com o STF e com a magistratura do país. Não se está discutindo aumento de salário, mas a funcionalidade do teto constitucional”, diz.

Na visão da magistratura, o teto constitucional tem caráter moralizador. “Quando o teto para o funcionalismo foi criado tinha servidor público que ganhava R$ 80 mil de salário. Nós defendemos o teto. A questão envolve muito mais direito constitucional do que economia. Por isso, precisamos qualificar o debate”, declara.

A esperança dos juízes está no ministro da Defesa Nelson Jobim, que já foi ministro da Justiça e presidente do Supremo. A classe espera que ele aceite a missão de levar ao governo os argumentos. “Ele criou o teto constitucional, quando presidiu o Supremo”, explica, “é muito respeitado por toda a magistratura e pode resolver esse impasse pela habilidade que tem como jurista e constitucionalista. Pode assessorar a presidente Dilma, tem o perfil ideal.”

Outra opção é Michel Temer, vice-presidente da República. De acordo com Wedy, Temer pode auxiliar o governo para “a elevação do nível do debate como constitucionalista que é, tornando-o mais técnico, qualificado e menos emotivo”.
