Entidades representativas de servidores públicos estão atentas ao que consideram mais uma ameaça ao funcionalismo. É que o relator do projeto da Lei de Diretrizes Orçamentárias (LDO) 2012, deputado Márcio Reinaldo Moreira (PP-MG), apresentou um substitutivo com o congelamento do auxílio-alimentação. O Sindjus, que representa servidores do Judiciário e do MPU, por exemplo, contratou um consultor para analisar a questão. O substitutivo traz o seguinte texto: “Art. 23. Fica vedado o reajuste, no exercício de 2012, dos benefícios auxílio-alimentação ou refeição, quando o valor unitário vigente do benefício pago pelo órgão ou entidade no âmbito dos poderes e do MPU for superior ao valor médio da União, para cada um dos referidos benefícios, praticado no mês de março de 2011. A diretoria do Sindjus também procurou o diretor-geral do STF, Alcides Diniz, para saber que atitude o Judiciário tomará para barrar a proposta.

Diniz afirmou que a assessoria parlamentar dos tribunais vai tratar do assunto. O sindicato também buscará, junto com o Sindilegis, que representa o pessoal do Legislativo e do Tribunal de Contas da União, formas de garantir que o dispositivo seja excluído. A justificativa do governo seria de que o auxílio dos servidores do Executivo é inferior ao do Legislativo, Judiciário e Ministério Público. “Não faz sentido nivelar por baixo, e vamos lutar contra essa proposta”, rebate o coordenador-geral do Sindjus, Cledo Vieira. O substitutivo prevê que, para apuração dos valores médios a que se refere o artigo 23, os órgãos dos poderes e do MPU encaminharão à Secretaria de Orçamento Federal do Ministério do Planejamento, cópia dos atos legais relativos aos valores per capita praticados em seu âmbito no mês de março de 2011, os quais servirão de base para a edição de Portaria, pela referida secretaria, que divulgará os valores médios do benefício.”
